Newbie here...and this might be obvious... I just purchased an Apparition 670, my first "automatic" knife of any kind. It dawned on me that according to NC law, I've got myself an illegal knife. Here is a reference to the law (bold text is mine): http://www.jus.state.nc.us/NCJA/ncfirearmslaws.pdf
I can't image a "spring-assisted" knife would be allowed in NC, given the law I've cited. For now, I've removed the optimizer, because there is no way I want to jeopardize losing my NC handgun carry permit. Can someone else from NC confirm what I am writing here? Thanks! | ||

Hey frandy go to walmart and look if they have kershaw assisted knives there. If they do more than likley you are leagel to carry the 670 in your state. Its the walmart test lol. I'm in NC and going through the same dilemna. I have a BM902SD2, Mini Nitrous Stryker. As I understand it (and it's my understanding ONLY), since you don't open it via a mechanism in the handle, it is not considered a switchblade. Also since you must start the opening process via the thumbstud, located on the blade, it's legal. Like I said, it's only my understanding. I could be wrong. Hopefully, someone more qualified than I, can help with a better answer. | ||

I'm not an attorney, and don't even play one on TV, but did look into this recently for my own information. The core of this law is: "§ 14-269. Carrying concealed weapons. (a)It shall be unlawful for any person willfully and intentionally to carry concealed about his person any bowie knife, dirk, dagger, slung shot, loaded cane, metallic knuckles, razor, shurikin, stun gun, or other deadly weapon of like kind, except when the person is on the person's own premises." One of the exceptions to this section is the "ordinary pocket knife" in the paragraph originally quoted. But please note that the core of this law prohibits concealed carry, not open carry. Prevailing thought among the dealers and LEOs with whom I've spoken is that if the pocket clip is used and the clip is visible, the knife is not considered concealed. It might be a good idea to check with an attorney for any case law regarding this, or maybe ask a local prosecutor what their office's position is. There are, of course, places and occasions in which carrying any weapon is not permitted, such as at educational institutions or extra-curricular activities. NC law also states: "§ 14-269.6. Possession and sale of spring-loaded projectile knives prohibited. (a)On and after October 1, 1986, it shall be unlawful for any person including law-enforcement officers of the State, or of any county, city, or town to possess, offer for sale, hold for sale, sell, give, loan, deliver, transport, manufacture or go armed with any spring-loaded projectile knife, a ballistic knife, or any weapon of similar character. Except that it shall be lawful for a law-enforcement agency to possess such weapons solely for evidentiary, education or training purposes." Some folks, including a couple of LEOs, think that this applies to OTF automatics. But, every definition of "projectile" and "ballistic" knife that I can find specifies that the blade detaches from the handle and flies through the air. So OTF autos appear to be in the same class as side-openers, and are regularly sold throughout the state by reputable dealers. Sorry for the long post, but hopefully the info helps. | |||

In my experience I have purchased several BM automatics from a couple different dealers in NC with no special license or permit. I don't know the laws but unfortunatly the vagueness of the law and grey area of AO's leaves the decision up to the officers involved. ------------------------------ | |||
